By downloading or using HabitAI (the "App"), you agree to be bound by these Terms of Service ("Terms"). These Terms form a legally binding agreement between you and HabitAI (referred to as "we", "us", or "our"). If you do not agree to any part of these Terms, you must not use the App.

2. Eligibility and License to Use

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use HabitAI.

We grant you a personal, limited, non-transferable, non-exclusive license to install and use the App on a device that you own or control, for personal and non-commercial use only.

3. Accounts and Registration

To access certain features you may need to create an account. You agree to provide accurate and complete information during registration and keep your login credentials secure. You are responsible for all activities that occur under your account.

4. Subscription and Payment

HabitAI is free to download, but full access requires a paid subscription through in‑app purchases.

• Auto‑Renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the billing cycle ends.
• Lifetime Access: A one‑time purchase option may be offered that grants access to premium features for the lifetime of the product’s availability.
• Managing Subscriptions: Subscriptions can be managed in your Apple ID or Google Play account settings.
• No Refunds: Subscription charges are generally non‑refundable except where required by law.

5. Permitted Use and Restrictions

You agree to use HabitAI only for lawful purposes. You must not:

• Copy, modify, reverse engineer, or distribute the App.
• Attempt to gain unauthorized access to our systems.
• Use the App to transmit unlawful, harmful, or abusive content.
• Commercially exploit the App without permission.

6. Intellectual Property

All content within HabitAI including text, graphics, logos, designs, software code, and AI generated responses are owned by HabitAI or its licensors and protected by intellectual property laws.

7. Disclaimer of AI Advice

The App may provide AI generated answers or coaching. This information is not medical, legal, financial, or professional advice and should not be relied upon for important decisions.

8. Disclaimer of Warranties

The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind. We do not guarantee the App will always be uninterrupted, secure, or error‑free.

9. Limitation of Liability

To the maximum extent permitted by law, HabitAI shall not be liable for indirect, incidental, or consequential damages arising from your use of the App.

10. Indemnification

You agree to indemnify and hold harmless HabitAI and its affiliates from any claims arising from your misuse of the App or violation of these Terms.

11. Changes to These Terms

We may update these Terms periodically. Continued use of the App after changes means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of South Australia. Any disputes will be resolved in courts located in Adelaide, South Australia.
